Signin Computer System use agreement

• Services Provided by DataII: DataII will provide application framework, functionality, and support to the application user in form of SignIn computer system. Application access and backup is an external part of the system managed by www.phpwebhosting.com. It is included in the SignIn service fees.
• Fees: Monthly service fee covers data hosting, application hosting, and account maintenance. The service fee is due at the end of each month, unless paid by the year. The fee amount is agreed upon by the customer and service provider at the time of signup or renewal. All fees are non-refundable.
• Limitation of Liability: DataII liability for any action arising under this agreement, regardless of the form of action and whether in tort or contract, shall be limited to the amount of service fees paid by customer for the services from which the claim arose. In no event shall DataII be liable for: indirect, special, incidental, or consequential damages of any kind, including without limitation, lost data or lost profits, however arising, even if customer has been advised of the possibility of such damages. The parties agree to the allocation of risk set forth herein.
